Judge Throws Out Virgie Arthur's Dannielynn Appeal

HOLLYWOOD - A judge has thrown out an appeal by Anna Nicole Smith's estranged mother Virgie Arthur to prevent her baby granddaughter from leaving her home in the Bahamas.

Arthur had hoped to stop baby Dannielynn's father Larry Birkhead from leaving the islands to return to the U.S. with his daughter.

But at the Court of Appeals in Nassau earlier today, Arthur's request was ridiculed by a judge, who also ordered her to pay $3,000 in attorney's fees for wasting the court's time.

He told Arthur, "I am perplexed why this matter is before us."

Birkhead reportedly plans to first stop in Kentucky, where the photographer hopes to introduce his baby daughter to family members.
