Lohan, 21, faces a possible custodial sentence after she failed a police sobriety test in the early hours of Tuesday.
Under California law, repeat DUI offenders are served harsher punishments--and Lohan could be facing jail time.
But Michael Lohan--who has served a number of prison sentences--insists a stint in jail would do his daughter more harm than good.
He tells Access Hollywood, "I think the first 24 to 48 hours of any jail time is good enough to serve a person. It's a very, very trying process."
